The L-1A visa is for executives and managers, while the L-1B visa is for employees with specialized knowledge. L-1A holders may stay for up to 7 years, while L-1B holders are limited to 5 years. L-1A may lead to a green card through EB-1C, while L-1B typically requires PERM labor certification.
2Is there a minimum investment amount for the E-2 visa?
There is no statutory minimum investment for the E-2 visa. However, the investment must be substantial in relation to the type of business. Generally, investments under $50,000 may be scrutinized more closely. The key factor is that the investment must be sufficient to ensure the successful operation of the enterprise.
3Can I apply for a green card through the EB-5 program from abroad?
Yes, the EB-5 program is available to investors both inside and outside the U.S. If you are abroad, you file Form I-526 and then complete consular processing to obtain an immigrant visa. If you are in the U.S., you may adjust status after I-526 approval.
4How long does the PERM labor certification process take?
The PERM process typically takes 6-12 months, including the recruitment period, 30-day quiet period after filing, and DOL processing time. Premium processing is not available for PERM. After PERM approval, the I-140 petition takes 4-8 months (or 15 days with premium processing).
