Frequently Asked Questions
1What is the difference between affirmative and defensive asylum?
Affirmative asylum is filed with USCIS when you are not in removal proceedings. Defensive asylum is filed with the Immigration Court when you are already in removal proceedings. Both processes ultimately determine whether you qualify for asylum protection.
2Can I work while my asylum application is pending?
Yes. You may apply for an Employment Authorization Document (EAD) 365 days after filing your asylum application if USCIS has not yet made a decision. Asylum applicants are not authorized to work during the first 365 days.
3What happens to my family if I am granted asylum?
Your spouse and unmarried children under 21 who are in the U.S. may be granted derivative asylum status. Family members abroad may apply for derivative asylum status to join you in the U.S. within two years of your asylum grant.
4Can I travel outside the U.S. with a pending asylum application?
Travel outside the U.S. while your asylum application is pending may be risky. You should obtain advance parole travel authorization before traveling. If you return to your home country, USCIS may determine that your fear of persecution is no longer credible.
